Terms of Service

1. Agreement to Terms
By accessing or using CourseRecon ("the Service"), operated by CourseRecon LTD ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms apply to all users of CourseRecon.
2. Description of Service
CourseRecon is a race course analysis platform for endurance athletes. The Service provides:
- GPX and FIT file upload and terrain analysis
- Course difficulty scoring and segment breakdowns
- Elevation profiling and gradient analysis
- Readiness scoring based on athlete training data
- Training pacing recommendations
- Integration with third-party fitness platforms (e.g., Strava)
3. Account Registration
To use certain features, you must create an account. You agree to:
- Provide accurate and current information
- Keep your login credentials secure
- Notify us immediately of any unauthorised access
- Accept responsibility for all activity under your account
You must be at least 16 years of age to create an account.
4. Subscriptions and Payments
4.1 Free Tier
All registered users receive one free course recon. This is a one-time allocation — once used, it cannot be reset. Demo mode (using sample athlete data) is always available without limit and does not count towards the free recon.
4.2 Paid Options (Coming Soon)
CourseRecon is currently in free beta. Paid access is not yet available. When paid options launch, they will include:
- Single Race: unlimited analyses on one specific course for 12 months from purchase.
- Season Pass: unlimited analyses on any number of courses for 12 months from purchase.
Prices will be displayed in New Zealand Dollars (NZD) and will include GST where applicable. We will publish pricing on the Pricing page before any paid access is activated, and will provide at least 14 days' notice before charging existing users.
4.3 Payment Processing
When paid options become available, payments will be processed by Stripe. By making a purchase, you will also agree to Stripe's Terms of Service. We will not store your full credit card details on our servers.
4.4 Refunds
Refund terms will be published alongside paid option launch. We are committed to a fair refund policy.
4.5 Expiry and Renewal
Paid purchases will not auto-renew. Full terms, including duration and renewal options, will be published before paid access launches.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious files, malware, or data designed to disrupt the Service
- Attempt to reverse-engineer, decompile, or extract the source code of CourseRecon's algorithms or scoring systems
- Scrape, harvest, or systematically download data from the Service
- Resell, redistribute, or commercially exploit course analyses without our written consent
- Impersonate another person or misrepresent your affiliation
- Use automated tools (bots, crawlers) to access the Service without permission
We may suspend or terminate accounts that violate these terms.
6. Fitness and Health Disclaimer
THIS IS CRITICAL. PLEASE READ CAREFULLY.
CourseRecon provides course analysis, readiness scoring, and pacing recommendations for informational and educational purposes only. The Service does not provide medical, physiological, or professional coaching advice.
- Course difficulty scores, readiness assessments, and pacing recommendations are algorithmically generated estimates based on terrain data and training history. They are not guarantees of performance or safety.
- You are solely responsible for assessing your own fitness, health, and readiness to participate in any endurance event.
- Always consult a qualified medical professional before beginning any training programme or participating in an endurance event, particularly if you have pre-existing health conditions.
- Endurance sports carry inherent risks including but not limited to: musculoskeletal injury, heat illness, hypothermia, hyponatraemia, cardiac events, rhabdomyolysis, and death. CourseRecon does not eliminate or reduce these risks.
- Do not rely solely on CourseRecon's pacing or fuelling recommendations. Use your own judgement, listen to your body, and follow race-specific safety guidance from event organisers.
- CourseRecon is not a substitute for professional coaching, sports science consultation, or medical advice.
By using the Service, you acknowledge and accept these risks and agree that CourseRecon and its operators bear no liability for injury, illness, or death arising from your use of the Service's recommendations.
7. Intellectual Property
7.1 Our Content
CourseRecon's algorithms, scoring systems, user interface, branding, and original content are owned by us or our licensors and are protected by copyright and intellectual property laws. You may not reproduce, modify, or distribute our proprietary content without written permission.
7.2 Your Content
You retain ownership of any data you upload (GPX files, FIT files, activity data). By uploading content, you grant us a limited, non-exclusive licence to process, analyse, and store that data solely to provide the Service to you.
7.3 Third-Party Data
Course analysis is performed on GPS track data you supply (GPX or FIT files). For New Zealand catalogue races, CourseRecon supplements course metadata with publicly available trail classification data from the New Zealand Department of Conservation (DOC). We are not affiliated with DOC, and trail ratings sourced from DOC are used for informational purposes only.
8. Third-Party Integrations
CourseRecon integrates with Strava to import athlete training data. When paid options are available, payments will be processed by Stripe. Your use of these integrations is also subject to those services' respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services.
You may revoke third-party access at any time through your account settings or the third-party platform directly.
9. Data and Privacy
Your privacy matters to us. Please review our Privacy Policy for details on how we collect, use, and protect your data. Key points:
- We process your data to provide the Service
- We do not sell your personal data to third parties
- You can export individual analyses as JSON at any time from the readiness results page
- You can delete your account and all associated data at any time from your account settings
10. Service Availability and Modifications
- CourseRecon is provided "as is." We aim for high availability but do not guarantee uninterrupted access.
- We may modify, update, or discontinue features with reasonable notice.
- Terrain analysis accuracy depends on the quality of the GPS track data you provide. We do not guarantee the accuracy or completeness of any analysis.
11. Limitation of Liability
To the maximum extent permitted by New Zealand law:
- CourseRecon and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- This limitation applies to all causes of action, including breach of contract, negligence, and other torts.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Consumer Guarantees Act 1993 or other applicable New Zealand legislation.
12. Indemnification
You agree to indemnify and hold harmless CourseRecon and its operators, employees, and affiliates from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your participation in any endurance event
- Any content you upload to the Service
13. Dispute Resolution
These Terms are governed by the laws of New Zealand. Any disputes will be resolved through:
- Good faith negotiation — 30-day period for informal resolution
- Mediation — If negotiation fails, through a mutually agreed mediator in Auckland, New Zealand
- Courts — The courts of New Zealand shall have exclusive jurisdiction
14. Termination
- By you: You may delete your account at any time from your account settings. Deletion is immediate and permanent — all your data (athlete profile, analysis history, and Strava connection) is removed from our systems at the time of deletion.
- By us: We may suspend or terminate your account for violation of these Terms, with notice where practicable.
- Upon termination, your right to use the Service ceases. We will retain your data in accordance with our Privacy Policy and applicable law.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 14 days before changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
